Terms of business
How we work, in writing.
These are the terms we work to. They are written in plain English on purpose, because terms nobody reads protect nobody.
Terms of business
These are the terms we work to. They are written in plain English on purpose, because terms nobody reads protect nobody.
They apply alongside the quotation we give you. Where a quotation says something different from this page — a specific inclusion, exclusion or guarantee period — the quotation is what governs your job.
Who you are contracting with
Masters Roofing And Construction Ltd, registered in England and Wales, company number 15863920, registered office 55 Grafton Road, Worthing, West Sussex BN11 1QY. Referred to below as "we" or "us".
Inspections and quotations
- Inspections and written quotations are free, with no obligation, and we do not charge for a visit that finds nothing wrong.
- A quotation is based on what could be seen and reasonably inferred at the time of the survey. Roofs conceal things; where we can see a risk of something turning up once the covering is off, we flag it in the quotation rather than after.
- Quotations are valid for 30 days. We do not use expiry-date pressure and if you come back later we will simply re-price it honestly against current material costs.
- Prices exclude VAT only if the quotation says so. We will always make the position clear on the document rather than leaving it to be discovered on the invoice.
Accepting a quotation
A contract is formed when you accept our quotation in writing — by email, by text, or by signing and returning it — and we confirm a start date. We will confirm what has been agreed so both of us are working from the same document.
Your right to cancel
If you are a consumer and the contract was agreed away from our business premises — which for a roofing job it almost always is, whether at your home or by email and phone — you have a statutory right to cancel within 14 days of entering into it, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
You do not have to give a reason. Tell us in writing within those 14 days and we will cancel the contract and refund any deposit.
If you ask us to start work within the 14-day period and then cancel, you keep the right to cancel but you must pay for the work already done and materials already ordered specifically for your job. We will ask you to confirm in writing before starting early, so nobody is caught out by this.
Variations and unforeseen work
- If we find something that was not visible at survey — rotten timber, a failed deck, a structural problem — we will stop, show you, and tell you what it will cost before doing anything about it.
- We will not carry out extra work and add it to your invoice without your agreement. Ever.
- If you ask for changes once work has started, we will price them and confirm in writing before proceeding.
Access, scaffolding and the site
- You agree to give us safe access to the property and to the areas we need at the agreed times.
- Where scaffolding is required it will be itemised separately in the quotation. Where it has to stand on land you do not own, or on a public highway, any licence or permission is your responsibility unless the quotation says we are obtaining it.
- Please move vehicles, garden furniture and anything fragile clear of the working area before we start. We sheet and protect what we can, but a roof job puts material and dust in places nobody expects.
- We are responsible for the safety of our own operations and we are fully insured. We are not responsible for pre-existing defects we did not cause, or for damage arising from a structural problem we advised you about and were not asked to fix.
Timing and weather
We give you a realistic window rather than an optimistic one, and we tell you as soon as we know it is going to move.
Roofing is weather-dependent and some systems have minimum temperatures and dry conditions they must be laid in. We will not lay a system in conditions where it cannot cure or bond properly in order to hit a date — doing so is how a new roof fails in three years. A delay for weather is not a breach of contract, and we will not charge you for it.
Payment
- Payment terms are set out on your quotation and invoice. On larger jobs we may ask for a materials deposit or for staged payments against completed stages; on smaller work payment is normally due on completion.
- We do not ask for full payment up front, and you should be wary of any contractor who does.
- Invoices are due within 14 days unless the quotation says otherwise.
- Materials remain our property until they are paid for. Risk in them passes to you once they are installed.
- Late payment may attract interest and reasonable recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998, where that Act applies.
Guarantees
What you get is set out on your quotation and issued in writing on completion. In summary:
- Workmanship
- A written guarantee of 5 to 10 years depending on the system installed, covering our workmanship.
- Leak-free
- On all new roof installations and flat roof systems.
- Storm protection
- On specified roofing systems, covering wind uplift and driving rain.
- Manufacturer cover
- SIG Roofing One Warranty on qualifying projects, and RESTEC’s 20-year manufacturer guarantee on liquid applied systems and Flexitec 2020 GRP roofs installed by Dean, registered with the manufacturer on completion.
- Checkatrade
- £1,000 guarantee on work arranged through Checkatrade, subject to their terms and conditions.
What guarantees do not cover
- Damage caused by other trades, by you, or by anyone else working on the property after us.
- Storm damage beyond what the specified system is rated for, accidental damage, vandalism, or subsidence and structural movement.
- Pre-existing defects elsewhere on the property that we advised you about and were not instructed to remedy.
- Blocked gutters, outlets and valleys where these have not been maintained. Keeping them clear is normal upkeep, not a defect.
- Areas of the roof we did not work on.
- Anything where the work has been altered or interfered with by someone else.
If something goes wrong
Tell us. Call 07377 884529 or email mastersrandcltd@gmail.com and we will come and look. We would far rather come back and put something right than have you live with it or leave a review about it.
If you are a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 — including the right to services carried out with reasonable care and skill.
If work was arranged through Checkatrade you also have their complaints process and guarantee available to you.
Liability
We are fully insured and we accept responsibility for loss or damage caused by our negligence or by our failure to carry out the work with reasonable care and skill.
We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, we are not liable for indirect or consequential losses, and our total liability for any one job is limited to the value of that contract or the amount recoverable under our insurance, whichever is the greater.
